Exxon unit to pay $100,000 to resolve alleged clean air act violation

IRVING -- An Exxon unit has agreed to pay a $100,000 penalty to resolve an alleged violation of the Clean Water Act, the U.S. Department of Justice and U.S. Environmental Protection Agency said.

The settlement requires Exxon subsidiary XTO Energy Inc. to also spend an estimated $20 million on a plan to improve wastewater-management practices.

Discharge of wastewater from XTO Energy' s Penn Township facility in Pennsylvania--which is used for the storage of wastewater generated by natural gas exploration, commonly known as fracking, and production--was discovered by the Pennsylvania Department of Environmental Protection during an inspection of the facility. At the time, XTO stored wastewater generated from energy-extraction activities conducted throughout the state at its Penn Township facility and, at the time of the release, stored fluid produced from its operations in the area, the DOJ and EPA said.

The EPA conducted an investigation and determined that wastewater stored at the facility contained the same variety of pollutants, including chlorides, barium, strontium and total dissolved solids, that were observed in surface waters.

The improvements to XTO' s wastewater management are estimated to reduce discharges of total dissolved solids by 264 million pounds over the course of the next three years. XTO will increase wastewater recycling and will properly dispose of wastewater generated by its natural gas activities across the mid-Atlantic region.

An Exxon representative wasn' t immediately available for comment.

Exxon shares were recently up 89 cents at $94.35. The stock is up 8.9% over the past three months.
